JAKARTA, MAJALAHCEO.COM – The trial of unilateral termination of employment by PT Tech Data Advanced Solutions Indonesia industrial relations court (PHI), has an agenda of the defendant reply for a motion given by the plaintiff.
Defendant Attorney Yanto Robert again asked in the reply regarding the completeness of the plaintiff’s power of attorney. The motion itself is not read out, only submitted directly in the form of documents.
“We, as legal counsel, are feeling strange and outlandish. How could the original power of attorney that was signed in America, already in Indonesia and used to register a lawsuit,” he said after the trial at the Jakarta District Court, Wednesday (6/26).
Even though based on the statement of the plaintiff’s attorney, Ronny Asril, the completeness of the power of attorney is being processed abroad. This was conveyed through the trial some time ago.
Previously, the defendant’s attorney team checked with the Case Clerk, Thursday, May 14, 2020 asking for the completeness of the power of attorney for trial purposes. But until now it has not been equipped.
“It’s strange, if it is said to be processed there, why is it already in Indonesia. The document should still be there,” said Robert.
Knowing this, Chief Judge Bintang Al who handled the case will consider the validity of the power of attorney from the plaintiff.
“We are considering its validity,” said Chief Judge Bintang Al in the trial.
Aside from having a reply agenda from the defendant, this trial also submitted evidence from the plaintiff. The main point of this duplicate is the refutation of the plaintiff’s legal counsel.
“We still hold on to our propositions. What they did by using these ways are not right. Our clients have no mistakes, so they forced (this lawsuit),” added Robert. (CEO/rls/dey)
